This book seeks to take a critical approach to the role of the law in shaping and defining tourism and the tourism experience. A central argument of the book will be that the underlying values of tourism are often at odds with a concern for human rights, cultural heritage and sustainable environments. But it will be argued that it would be wrong to think that the role of law is simply relegated to that of dealing with the hard edges of the tourist industry and tourist behaviour. Instead, we will argue that the law itself shapes and has shaped the nature of tourism and that, importantly; there are choices in how it does this. The book will argue that there is a need for a more focussed role for law in tourism and that international law can provide standards within which domestic law can evolve a 'new' law for tourism which might promote human rights and the preservation of culture and the environment.
